What types of companies and drivers are required to be in the DOT FMCSA drug and alcohol testing program? Hi, Joe Riley here, President of National Drug Screening. I love to answer questions about drug testing. Today I'm going to focus on the Department of Transportation (DOT) drug testing, specifically the Federal Motor Carrier Safety Administration (FMCSA). I'm going to talk about the types of companies and drivers that are required to be in the DOT FMCSA drug and alcohol testing program. - This is a common question because many companies that operate trucks want to know if they need to be part of the DOT drug and alcohol testing program. Just because a company operates trucks or has drivers with CDL licenses does not necessarily mean they are a covered employee for the DOT drug and alcohol testing program. - Covered employees need to meet specific criteria. The criteria are as follows: 1. Do they have a CDL and operate a commercial motor vehicle that weighs 26,001 pounds or more, or have a combined weight rating of 26,001 pounds or more with anything being towed? - If a company's trucks or vans weigh under 26,001 pounds, they would not be required to have the DOT drug and alcohol testing program. However, it is still a good idea to have a drug and alcohol testing program for liability purposes and to ensure the safety of drivers and the general public. 2. Does the company transport people, typically by buses? If a bus is capable of transporting 16 or more passengers, including the driver, then that driver should be included as a covered employee in the DOT drug and alcohol testing program.
