Workers compensation doesn't really involve the courts as you know them. It happens inside of the Industrial Commission. The way you start a case is by filing a form 18. Employees file form A.T.E.N.S. Employers file form 549. This kind of initiates the case in its very simple form. But it's important that the form is filled out accurately. I encourage you, if you need to fill out one of those forms and you're considering consulting a lawyer, consult your lawyer before you file the form A.T.E.N.S. so they can help you with that. Lawyers can do the forms or employees can do the forms. If you're going to hire a lawyer, I encourage you to let your lawyer fill out the form. While it's a very straightforward form, the question that deals with how did it happen is critical. You want to make sure you answer in such a way that it conforms to the North Carolina law in terms of a compensable workers compensation injury.
